Terms & Conditions

These Terms of Use (“Terms”) govern your access to and use of the Trace Law Partners website (“Platform”), operated by Trace Law Partners, (“Trace Law Partners”, “we”, “us” or “our”).

 

By accessing or using the Platform, the users (“you” or “your”) agree to be bound by these Terms and our Privacy Policy. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform, and any continued use will be deemed as your acceptance of the Terms.

 

These Terms are an electronic record in terms of the Information Technology Act, 2000 generated by a computer system and does not require any physical or digital signatures.

 

A. ELIGIBILITY

By accessing or using the Platform, you represent and warrant that you (i) are of legal age, (ii) competent to enter a contract under the laws of India.

 

You further acknowledge and agree that it is your sole responsibility to ensure that you meet and continue to meet such eligibility criteria at all times while using the Platform. 

 

Trace Law Partners reserves the right to suspend or terminate your access to the Platform if it becomes aware, or has reason to believe, that you do not satisfy such legal or regulatory requirements under the applicable law, or if you breach these Terms.

 

B. USER ACKNOWLEDGMENTS AND OBLIGATIONS

By accessing or using the Platform, you expressly agree, acknowledge, and undertake the following:

 

(a) The use of this Platform does not create an attorney-client relationship. The information contained on this Platform is general information and is not to be construed as legal advice, nor intended to solicit clients of work.

 

(b) You shall not use the Platform in any manner so as to affect its functionality. 

(c) You shall use the Platform strictly in accordance with applicable laws, rules, and regulations and these Terms. You shall not use the Platform for any unlawful or unauthorized purpose.

(d) You shall not modify, edit, or take out of context any information on Trace Law Partners’ Platform. 

(e) Trace Law Partners may restrict your access to the Platform at any time for any reason.

The information on this Platform is provided for general informational purposes only and may not be accurate, complete, or current. Trace Law Partners make no warranties regarding the content of the Platform, and disclaims all liability for any loss or damage arising from its use or interpretation. Trace Law Partners does not assume any liability for any third-party links available on the Platform. 

 

 

The Platform and all content, and features made available to you through it are provided on an “as is” basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Trace Law Partners disclaims all warranties, whether express, implied, statutory, or otherwise. We do not guarantee that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

 

D. THIRD-PARTY INVOLVEMENT

The Platform may also contain links to websites, platforms, or content operated by third parties. These links are provided for your convenience only and do not imply any endorsement or responsibility by Trace Law Partners for the content, services, or practices of such third parties. Access and use of such third-party websites or services is entirely at your own risk.

 

E. DATA COLLECTION AND PRIVACY

We collect and process your sensitive personal data or information (including financial information and identity documents) in accordance with our Privacy Policy and applicable laws, including the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. Please review the Privacy Policy carefully before proceeding.

 

F. PROHIBITED CONDUCT

You agree to use the Platform strictly in accordance with these Terms, applicable laws, and in a manner that respects the rights and integrity of other users, the Platform, and third parties. You expressly agree that you shall not, directly, or indirectly:

 

(a) Misrepresent your identity, eligibility, or legal capacity in any form, including by submitting false, misleading, forged, altered, or fraudulent documents or information for the purpose of accreditation or otherwise.

 

(b) Impersonate any individual or entity, falsely claim an affiliation with any person or organization, or mislead others as to your affiliation or authority.

 

(c) Engage in any form of fraudulent, illegal, unethical, or deceptive behaviour while using the Platform. Attempt to gain unauthorized access to any portion of the Platform, including user accounts, data, systems, services, networks, or infrastructure, whether through hacking, phishing, social engineering, use of bots or automated tools, password mining, or other unlawful means.

 

(d) Deploy or introduce any viruses, malware, spyware, trojans, worms, logic bombs, or other harmful code intended to damage or interfere with the operation, security, or availability of the Platform or any associated systems or data.

 

(e) Circumvent, disable, or interfere with any security-related features of the Platform, including any features that restrict or prevent copying of content or enforce limitations on use.

 

(f) Access or use the Platform for data mining, scraping, harvesting, or extracting information, whether manually or through automated means, without express written authorization.

 

(g) Frame, mirror, or deep-link to any page of the Platform without prior written consent, or attempt to reverse engineer, decompile, or disassemble any part of the Platform.

 

(h) Engage in any conduct that is intended or likely to cause reputational harm, legal exposure, or other damage to the Platform, or Trace Law Partners. 

 

G. INDEMNITY

To the extent allowed by law, you agree to indemnify, defend and hold harmless Trace Law Partners, and its partners, employees, officers, agents, associates, and service providers from any and all losses, claims, demands, fees (including reasonable attorneys’ fees), liabilities, expenses, fines arising out of your breach of these Terms and / or use of this Platform. 

 

H. NO LIABILITY 

To the fullest extent permitted under applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform

 

I. INTELLECTUAL PROPERTY

The Platform and all content on the Platform, including but not limited to software, text, graphics, logos, and trademarks, are owned by or licensed to Trace Law Partners and are protected under applicable intellectual property laws. You are granted a limited, non-exclusive, revocable right to access and use the Platform solely for its intended purpose and in accordance with these Terms. You may not copy, reproduce, modify, distribute, transmit, display, perform, or otherwise use any part of the Platform or its content without the prior written consent of Trace Law Partners.

 

J. AMENDMENT OF TERMS

We reserve the right to modify these Terms at any time. Please note that the continued use of the Platform after such updates shall be deemed acceptance of the revised Terms.However, we recommend that you review these Terms periodically to stay informed of any updates or changes.

 

K. GOVERNING LAW AND DISPUTE RESOLUTION

(a) These Terms shall be governed by and interpreted in accordance with the laws of India.

 

(b) Any dispute, controversy, or claim arising out of or in connection with these Terms, including any question regarding their existence, validity, interpretation, or performance, shall be resolved through arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time. The arbitration shall be conducted by a sole arbitrator, to be appointed by the Platform. The seat and venue of arbitration shall be Mumbai, India, and the proceedings shall be conducted in English.

 

The arbitral proceedings and the award, including the existence of the dispute, shall be kept strictly confidential by all parties involved, except where disclosure is required by applicable law or regulatory authority. The arbitral award shall be final and binding on all parties, and may be enforced in any court of competent jurisdiction. Each party shall bear its own costs and expenses in relation to the arbitration, unless otherwise determined by the arbitral tribunal.

L. MISCELLANEOUS 

These Terms constitute the entire agreement between you and Trace Law Partners with respect to the use of the Platform and supersede all prior communications and understandings, whether oral or written. If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, the remaining provisions shall remain in full force and effect. Further, any failure of Trace Law Partners to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

 

You may not assign or transfer any of your rights or obligations under these Terms without prior written consent of Trace Law Partners. Trace Law Partners may freely assign or transfer its rights and obligations to any of its affiliates or in connection with a merger, acquisition, sale of assets, etc.

 

In the event you breach these Terms, Trace Law Partners may pursue all remedies available under law and equity.
